Terms of Use

These Terms of Use govern access to City Pixels™ by Side Eye Tom™, including public browsing, free reader accounts, author tools, stories, books, Story Trails, City Claims, and related services operated by Fallen House Media LLC. Creating an account requires agreement to these Terms. City Claim purchases are also governed by the separate Claim Terms and Refund Policy.

1. Eligibility and account age

You must be at least 13 years old to create an account. A person under the age of legal majority where they live should use City Pixels only with permission from a parent or legal guardian. The service is designed for users in the United States.

2. One account for readers and writers

A free reader account may later add an author profile and writer tools. You are responsible for providing accurate information, keeping your password secure, and notifying City Pixels if you believe an account has been compromised. You may not impersonate another person, create an account for deceptive purposes, sell account access, or use another person’s account without permission.

3. Public and private features

Public stories, bookshelves, author pages, city pages, and Story Trails may be viewed without an account. Account features may include private Pixel Pins, follows, Pixel Props, reading history, Pixel Passport activity, Pixel Stream results, Pixel Pings, drafts, and account settings. Features may change as the platform develops.

4. Author profiles and submitted content

You retain ownership of content you submit. By submitting text, names, pen names, biographies, book information, stories, images, links, logos, audio, video, or other materials, you confirm that you have the rights and permissions needed to use them. You grant Fallen House Media LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, edit for presentation or safety, display, distribute, and promote the submitted material as reasonably necessary to operate and publicize City Pixels. This license ends when the material is removed from active publication, except for reasonable backup, archival, legal, and already-created promotional copies.

5. Review, publication, and moderation

Author profiles, books, stories, Story Trails, City Claims, links, and other public materials may require review. Submission does not guarantee approval, publication, placement, ranking, traffic, sales, or continued availability. Fallen House Media LLC may request changes, decline, edit, unpublish, restrict, or remove material that violates these Terms, the Content Standards, applicable law, third-party rights, or platform safety.

6. Acceptable use

You may not use City Pixels to violate law; infringe intellectual-property or privacy rights; distribute malware; scrape or harvest accounts or data; evade security controls; interfere with the service; harass, threaten, deceive, or impersonate others; publish private personal information without permission; manipulate engagement; or submit content that violates the Content Standards.

7. City Claims are separate placements

A City Claim is an annual sponsorship/listing placement and is separate from reader and writer accounts. It does not create ownership of a city, government affiliation, trademark rights, editorial control, guaranteed results, or legal exclusivity. Claim availability, pricing, payment, review, renewal, and refunds are governed by the Claim Terms and checkout disclosures.

8. Payments and third-party services

Payments may be processed by approved third-party payment providers. City Pixels does not ask users to send full card or bank credentials through ordinary contact forms. Links to bookstores, author sites, social platforms, payment providers, and other third-party services are provided for convenience; those services have their own terms and privacy practices.

9. City Pixels intellectual property

The City Pixels and Side Eye Tom names, logos, artwork, site design, original copy, code, map presentation, and platform organization are owned by or licensed to Fallen House Media LLC. These Terms do not grant permission to clone, resell, reproduce, or commercially exploit those materials except as allowed by law or written permission.

10. Copyright and rights complaints

Use the contact page to report alleged copyright infringement, unauthorized likeness use, impersonation, or another rights concern. Include the material involved, its location on City Pixels, the basis of your rights, and reliable contact information.

11. Service availability and disclaimers

City Pixels is provided on an “as available” basis. Fallen House Media LLC does not promise uninterrupted operation, permanent storage, error-free content, specific discovery placement, search ranking, traffic, sales, readership, income, or business results. Users should keep their own copies of submitted work.

12. Limitation of liability

To the fullest extent permitted by law, Fallen House Media LLC and its owners, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from use of the platform, third-party links, content decisions, service interruptions, or loss of data. Nothing in these Terms limits rights or remedies that cannot legally be limited.

13. Suspension and termination

City Pixels may suspend or terminate accounts, submissions, or access when reasonably necessary for security, fraud prevention, legal compliance, repeated policy violations, or protection of users and the platform. You may stop using the service at any time and may request account assistance through the contact page.

14. Governing law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules, except where applicable law requires otherwise.

15. Changes

These Terms may be updated as City Pixels adds features or legal requirements change. The current version and update date will be posted here. Material changes may also be communicated through the site, account, or email when appropriate.
